GOVERNING LAW AND JURISDICTION

To resolve any dispute or matter relating to this website or the activities developed on it, Spanish law shall apply, to which the parties expressly submit. The Courts and Tribunals nearest to BARCELONA are competent to resolve all disputes arising or related to its use.

RAFFLE

1. Identification of the organizing company.

Versa Design S.L., with registered office at Carrer Mitgera, 19, 46560 Massalfassar, Valencia, and with NIF B64995640, responsible for the website, from now on RESPONSIBLE, makes available to users the present document, to inform all users of the website regarding what are the legal conditions of the raffles carried out.

2. Start and end dates of the raffle and geographic scope.

The start and end dates of the raffle will be those indicated in the social network, website where the raffle takes place or in the publication where the information to participate is available. The participation will only be valid for the period of time stipulated in the publication.

RESPONSABLE reserves the right to postpone or extend the period of the raffle in case of major circumstances, as well as the right to interpret the present legal terms and conditions.

It will only be possible to participate from the locations stipulated in the publication of the raffle.

3. Rules and conditions for participation.

The raffle will be open to individuals over 18 years of age.

Fraudulent profiles or persons who have entered false data will not be allowed to participate in the campaign and therefore be winners.

Participation through agents or third parties, or the use of multiple identities, is also not allowed.

To participate, users must follow Zycle on Facebook and Instagram and follow all the steps indicated in the raffle publication.

RESPONSABLE reserves the right to make changes to the campaign during its development, should any cause arise that prevents it from being carried to a successful conclusion or in order to improve its progress.

4. Selection of the winner and mode of the draw.

The selection of the winners will be made on the date stipulated in the publication of the raffle through the AppSorteos among all participants who meet the conditions.

The winners will be mentioned in each social network. From that day the winner/s will have a period of 20 calendar days to contact Zycle and close a date on which to redeem their prize.

Versa Design S.L. is exempt from any responsibility in case there is any error in the data provided by the winners that prevents their identification.

Versa Design S.L. reserves the right to declare the prizes void, in the event that the winners do not meet the requirements mentioned in these rules, as well as in the case of not being able to locate the winner.

5. Information regarding the processing of personal data (in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016).

5.3. Periods of conservation of the information

The identifying data of participants will be kept for the time strictly necessary for the development of the raffle and during the legal deadlines that, where appropriate, are applicable.

5.4. Legal basis for processing: the legitimacy for the processing of data is the consent given by the participant with the participation in the raffle and, therefore, with the acceptance of these rules. However, in case of withdrawal of consent, this does not affect the lawfulness of the processing previously carried out.

5.5. International assignments and transfers

No assignment of data to third parties or international transfers will be carried out. Versa Design S.L., as processor of customer data, may access and store the data (within the EU) in order to offer the services of its platform to the customer within the framework/agreement/contract established with the customer and only for that purpose.

5.6. Rights of the Participant

The interested parties may exercise their rights of access, rectification, deletion, portability and limitation or opposition of the data in the cases and with the scope established by the GDPR EU 2016/679. Likewise, you also have the right to withdraw consent at any time. To exercise these rights you may contact RESPONSIBLE, by sending an email to admin@versades.com requesting to be removed from the database.

You are informed of your right to file a complaint with the Spanish Data Protection Agency (www.agpd.es).

6. Penalties in case of fraudulent use.

Fraud is understood as the use of independent platforms or applications to obtain votes or more participations in the raffle, as well as behaviors that we detect as apparently abusive and/or malicious.

The detection of any of these practices will result in the cancellation of the participation.

RESPONSABLE reserves the right to take legal action against those persons who carry out any type of act that could be considered as manipulation or falsification of the raffle.

RESPONSABLE is exempt from any liability for damages that may be due to the temporary lack of availability or continuity of the operation of the application through which participation in the promotion takes place, to the defrauding of the utility that users may have attributed to it and to the access to the different pages and sending of participation answers through the Internet.

7. Acceptance of the Legal Bases.

Participation in the raffle implies the acceptance of the present legal terms and conditions. Any manifestation of non-acceptance of all or part of the legal bases will imply the exclusion of the participant and, as a consequence, Versa Design S.L. will be released from the fulfillment of the obligation contracted with this participant.
